This User Agreement ("Agreement") is a legally binding contract between you ("User" or "You") and VitaTech ("we", "us", or "our"), the operator of the VitaTech online store (the "Website") specializing in personal care and health appliances. By accessing, browsing, or using the Website to place orders, you acknowledge that you have read, understood, and agreed to be bound by all terms and conditions herein. If you do not agree with any part of this Agreement, please refrain from using our services.
1.1 When you place an order on the Website, you are making a binding offer to purchase the selected products under the terms stated at the time of order. We reserve the right to accept or reject your order in whole or in part, including but not limited to cases of product unavailability, incorrect product information (e.g., pricing, specifications), or suspected fraudulent activity.
1.2 Upon receiving your order, we will send a confirmation email to your registered email address, acknowledging receipt of the order. This email does not constitute order acceptance. A final order confirmation, indicating successful processing and shipment arrangement, will be sent separately once your order is verified and confirmed by us.
1.3 You warrant that all information provided during order placement (e.g., name, contact number, delivery address) is accurate, complete, and up-to-date. We shall not be liable for delivery delays or failures caused by incorrect or incomplete information provided by you.
2.1 As explicitly stated, VitaTech exclusively supports Cash on Delivery (COD) for all orders. No online payment methods (credit cards, debit cards, e-wallets, etc.) are accepted at this time.
2.2 Upon delivery of your order, you (or your authorized representative) must inspect the products first. After confirming that the products are intact, undamaged, and consistent with your order, you shall pay the total order amount (as indicated in the final order confirmation) in cash to the delivery personnel.
2.3 If you refuse to pay or cannot provide valid cash payment upon delivery, the delivery personnel will have the right to return the order to us. You shall bear no additional fees for such returns, but we reserve the right to restrict your future order placement if repeated refusal occurs without reasonable cause.
2.4 If you authorize a third party to receive and pay for the order on your behalf, you confirm that such third party has the authority to do so, and you shall be fully responsible for their actions related to the order (including payment and product inspection).
3.1 We strive to ensure that all product information (descriptions, specifications, pricing, images) on the Website is accurate and up-to-date. However, we do not warrant that all information is error-free; occasional typographical errors, outdated specifications, or stock discrepancies may occur. In such cases, we will notify you promptly and provide options (e.g., order adjustment, cancellation) without imposing any liability on you.
3.2 Product availability is subject to real-time inventory. If a product becomes unavailable after your order is placed but before shipment, we will cancel the unavailable item(s) and notify you via email or phone. For COD orders, this means you will only pay for the items actually delivered.
3.3 You acknowledge that the color, texture, or minor details of physical products may vary slightly from the images on the Website due to lighting, display resolution, or manufacturing tolerances. Such minor differences do not constitute product defects.
4.1 We cooperate with third-party logistics partners to deliver your orders. Delivery times are estimated based on your location and will be indicated in the final order confirmation; we shall not be liable for delays caused by force majeure (e.g., natural disasters, traffic disruptions), logistics company errors, or your failure to be available at the delivery address.
4.2 It is your responsibility to inspect the products at the time of delivery. You should check for: (a) consistency with the order (product model, quantity, color); (b) no physical damage (dents, scratches, broken parts); (c) intact packaging. If any issues are found, you must notify the delivery personnel immediately and contact our customer service within 24 hours with photos/videos of the problem. Failure to do so may affect your eligibility for returns or refunds.
5.1 You may request a return and refund within 7 calendar days of delivery if: (a) the product is defective (e.g., malfunctioning, damaged); (b) the product is incorrect (different from the order); (c) the product is unused and in its original packaging with all accessories intact (for reasons other than defect or error).
5.2 To apply for a refund, contact our customer service with your order ID, detailed description of the issue, and supporting evidence (photos/videos). Our team will review your request within 3 business days and notify you of the result.
5.3 For approved refunds related to COD orders: (a) If you have already paid, we will arrange for a cash refund or bank transfer (per your request) within 5-7 business days after we receive and verify the returned product. (b) If you have not paid (e.g., you refused delivery due to a defect), no payment obligation applies.
5.4 Return shipping costs: We will bear the cost if the return is due to our error (defective, incorrect product). You will bear the cost if the return is for personal reasons (e.g., change of mind) and the product is in good condition.
6.1 We collect and use your personal information (e.g., name, contact details, delivery address) solely for the purpose of processing your orders, arranging delivery, providing after-sales support, and sending order-related notifications. We will not sell, rent, or share your personal information with third parties for marketing purposes without your explicit consent.
6.2 We implement reasonable technical and administrative measures to protect your personal information from unauthorized access, disclosure, or alteration. However, no data transmission over the internet is completely secure; we cannot guarantee absolute security, but we will take all commercially reasonable steps to safeguard your data.
7.1 You agree to use the Website only for lawful purposes and shall not: (a) submit false or fraudulent order information; (b) disrupt the Website’s operation or access it through unauthorized means; (c) use the Website to infringe on the intellectual property rights of VitaTech or third parties; (d) share your account credentials with others (you are solely responsible for all activities under your account).
8.1 To the maximum extent permitted by law, VitaTech shall not be liable for any indirect, incidental, consequential, or special damages (e.g., loss of use, loss of profit) arising from your use of the Website or the products purchased, even if we have been advised of the possibility of such damages.
8.2 Our total liability for any claim related to this Agreement or your order shall not exceed the total amount you paid for the relevant product(s).
9.1 We reserve the right to modify this Agreement at any time. Modified terms will be posted on the Website with an updated effective date. Your continued use of the Website after the modification constitutes acceptance of the new terms.
9.2 We may terminate or suspend your access to the Website immediately if you violate any terms of this Agreement. You may terminate this Agreement at any time by ceasing to use the Website.
10.1 If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10.2 This Agreement constitutes the entire agreement between you and VitaTech regarding your use of the Website, superseding all prior oral or written agreements.
